Notice of Public Hearing – Zoning Board of Appeals

Please be advised the Village of Middleville Zoning Board of Appeals will hold a public hearing on Monday June 14, 2021 at 7:00 p.m. or as soon thereafter as possible to consider an application for an appeal on property located on parcel 08-41-057-006-00 (also known as 412 Second Street) regarding a decision by the Zoning Administrator for refusing to provide a letter for 100 percent rebuild of a nonconforming residential home and residential use in the C-2 Highway Commercial District. The hearing will be held in the Council Chambers of the Village Hall, 100 E. Main Street, Middleville, MI 49333 and via zoom. The application to be considered by the Zoning Board of Appeals seeks the following appeal from the terms of the Village Code: Sec. 78-704(b), reestablishment of nonconforming buildings and structures, states in cases where the cost of repair or reconstruction does exceed 50 percent, the nonconforming building or structure shall not be placed unless in full compliance with the terms of this code, and absent any nonconformity. The applicant is seeking relief from the Zoning Board of Appeals to reverse, or modify, a decision by the Zoning Administrator to deny to submittal of a 100 percent rebuild letter per the standards found in Sec. 78-788(1).

Any interested person may attend the public hearing to offer comments to the Zoning Board of Appeals.  A copy of the appeal application is available for inspection at the Village office, 100 E. Main St., during regular business hours, 9:00 a.m. to 5:00 p.m. Monday through Friday.  Persons with special needs who wish to attend should contact the Village Clerk no less than 72 hours prior to the public hearing.
