Public Hearing – 3316 Bender Road Rezoning

Please be advised the Village of Middleville PLANNING COMMISSION will hold a PUBLIC HEARING on February 2, 2021 at 7:00 pm or as soon thereafter as possible to consider an application for REZONING of the properties located at 3316 Bender Road (also known as parcels #08-14-027-004-00 and #08-14-027-004-10). This hearing will be held via zoom teleconference during the regular Planning Commission meeting, which an interested person can participate by through the following link https://us02web.zoom.us/j/84124146062, meeting ID 841 2414 6062, passcode 622040 at 7 pm on Tuesday, February 2, 2021.

The parcels in consideration for rezoning were recently annexed into the Village of Middleville and shall require a Village zoning classification. The Rezoning applications to be considered seeks Planning Commission recommendation for approval to Village Council to rezone parcels #08-14-027-004-00 and #08-14-027-004-10 from Thornapple Township Agricultural Residential to Village of Middleville Zoning Classification R-1 Low-Density Residential.

 Any interested person may public hearing to offer comments to the Planning Commission. Any interested person may attend the public hearing to obtain information about the rezoning requests or provide comments to the Planning Commission. A copy of the rezoning application is available via email a request to the Village Clerk at ayalag@villageofmiddleville.org. Persons with special needs who wish to attend should contact the Village Clerk no less than 72 hours prior to the public hearings.  Written comments will be received up to and until the day of the hearing and may be addressed to the Planning Commission at PO Box 69, Middleville, MI 49333 or by email at ayalag@villageofmiddleville.org.

LDFA Zoom Meeting

The Village of Middleville will hold the Local Development Finance Authority (“LDFA”) meeting on Thursday, January 21, 2021 at 5:00 pm via electronic means using ZOOM online video conferencing.

Members of the public wishing to participate in this meeting must do so electronically via the following website address https://us02web.zoom.us/j/89671091422, Meeting ID: 896 7109 1422, Passcode: 786727. Detailed instructions for joining the video conference of the meeting and providing public comments via video conference are included below.

Alternatively, to participate in the meeting by providing public comment, you may email your public comment to the following email address ayalag@villageofmiddleville.org. Emails received prior to 7:00 pm on January 21, 2021 at the above-listed address will be read aloud during public comment. Persons with special needs who wish to attend should contact the Village Clerk no later than January 20, 2021 at 5:00 pm to make arrangements for participation.  In all other respects, the January 21, 2021 LDFA meeting will be held in accordance with Michigan’s Open Meetings Act and the Council rules of procedure, as those rules may be modified from time to time.

Notice of Closeout Public Hearing for Michigan Community Development Block Grant Funding for The Lofts of Middleville (100 E Main St)

The Village of Middleville will conduct a closeout public hearing on January 26, 2021 at 7 pm via zoom: https://us02web.zoom.us/j/88973686280, Meeting ID: 889 7368 6280, Passcode: 175089 for the purpose of affording citizens an opportunity to submit comments and receive a final report on the completion of The Lofts of Middleville CDBG grant.

The CDBG grant provided funding to assist in the construction of mixed-use rehabilitation of the building at 101 E. Main Street. The CDBG project benefitted at least 51% low to moderate-income persons; 0 persons were displaced as a result of the project.

Interested parties are invited to comment on the project in person at the public hearing or in writing through January 26, 2021 and addressed to Glorimar Ayala, Village Clerk, PO Box 69, Middleville, MI 49333 or via email  ayalag@villageofmiddleville.org.

Citizen views and comments on the CDBG project are welcome.

PUBLIC NOTICE

Notice of Public Hearing – Variances 200 Lafayette St & 303 Fremont St

Please be advised the Village of Middleville Zoning Board of Appeals will hold two public hearings on January 25, 2021 at 6:00 p.m., or as soon thereafter as possible, to consider applications for a variance on property located 200 Lafayette Street (also known as parcels #08-41-078-001-00, #08-41-078-002-00, #08-41-023-690-00, #08-41-023-290-00, #08-41-023-295-00, #08-41-023-294-00, #08-41-023-292-00, #08-41-011-001-10, #08-41-011-001-00, #08-41-012-008-00, #08-41-012-105-00, #08-41-012-101-00) to allow light poles to remain at a height of 22.5 feet from grade. The second variance application is for property located at 303 Fremont Street (also known as parcel #08-41-009-007-00) to request the placement of a detached accessory building in the front yard. The public hearings will be held via electronic means using Zoom video teleconference.

PUBLIC NOTICE IS FURTHER PROVIDED THAT, due to social distancing requirements and physical constraints at the Village Hall, MEMBERS OF THE PUBLIC WILL NOT BE PERMITTED TO ATTEND THE MEETING AT THE VILLAGE HALL IN-PERSON.

The applications to be considered by the Zoning Board of Appeals seeking the following variance from the terms of the Village Code:  Sec. 78-30, limiting the height of a light pole in all zoning districts to 20 feet from grade. The applicant is asking for a variance from approved site plans to keep light poles installed at 200 Lafayette Street premises at the height of 22.5 feet, a variance of 2.5 feet. The second variance application is against Sec. 78-21(e), which does not permit any detached accessory buildings to be located in any front yard. The applicant is seeking a variance to place a detached accessory building 1.5 feet into the front yard at 303 Fremont Street in the R-2 Medium Density Residential District.

Any interested person may attend the public hearings to offer comments to the Zoning Board of Appeals.  A copy of the Variance applications is available for inspection at the Village office, 100 E. INDUSTRIAL FACILITIES TAX EXEMPTION CERTIFICATE

PUBLIC NOTICE IS HEREBY GIVEN that the Village Council of the Village of Middleville will hold a public hearing on January 26, 2021, at or after 7:00 p.m. via electronic means using ZOOM video conferencing, on the application of Euro-Lighting Designs Inc., for an Industrial Facilities Tax (IFT) Exemption under the provisions of Act 198 of the Public Acts of Michigan of 1974, as amended (“Act 198”), for certain real property located at 945 Grand Rapids Street within the Village and legally described as follows:

Lot 5 within the Plat of Middleville Industrial Park [Liber 552, Page 550],
Village of Middleville, Barry County, Michigan (Permanent Parcel No. 08- 41-126-001-00).

Following the public hearing, the Village Council may consider a resolution to establish the requested Industrial Facilities Tax Exemption under the terms of Act 198.

Get ready for winter

What do you need to do before winter hits:

**Shake your mailbox— Time to check for rotting post(s) and loose screws now to prevent serious headaches later. If your mailbox moves, it’s not sturdy and could be knocked over by snow thrown from a passing snowplow. Much of the damage to mailboxes caused by snow coming off of the plow truck’s wing can be prevented by completing proper maintenance before the winter season.

During the winter season:

**On trash pick-up date, do not place your container on the road. It can be knocked over by snow coming off the plow truck and prevent from proper maintenance.

**Snow removal—All persons owning or occupying lots or parcels within the village limits which are bordered by a sidewalk on any side or sides shall remove snow from such sidewalk or sidewalks within 48 hours from the time any snowstorm shall cease. Should any person fail to remove snow as provided in subsection (a) of this section, the Director of the Department of Public Works shall cause such snow to be removed and the expense thereof shall be charged to the person violating this division. Should such person refuse to pay the charge stated in subsection (b) of this section, the Director shall report the same to the village assessor and such sum shall be assessed on such lots and collected the same as other village taxes. (Ord. No. 2060, § I, 1-11-2011; Ord. No. 2087 , § 1, 11-9-2016)  (Chapter 58, Sec. 58-107 Middleville Code of Ordinance)

**No Parking on Villages Streets—No vehicle shall be parked on any street in the Village between the hours of 2 a.m. and 6 a.m. Except as otherwise provided by section 66-123(c) below, no vehicle shall be parked in any village-owned or operated parking lot between the hours of 3 a.m. and 6 a.m.  (Ordinance No. 2090 , § 1, 7-25-2017)  (Chapter 66, Sec. 66-123 Middleville Code of Ordinance)

Park Visitors Public Notice

As a result of the COVID-19 pandemic, the Village of Middleville recognizes the need for outdoor physical activity and the benefit of using public parks. Please be advised Village parks and its amenities are not regularly sanitized. Please use caution when using the playgrounds and help children follow proper social distances to the greatest extent possible.

Stay at least 6 feet away from others you don’t live with (social distancing) and take other steps to prevent COVID-19. The Village of Middleville encourages all members of the public who will use the parks to adhere to CDC guidelines and social distancing. The Village of Middleville also encourages all visitors and renters to perform a wellness check prior to the use of this facility.
